Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and DrawLink ("DrawLink", "we", "our", "us") governing your access to and use of the DrawLink mobile application and associated services (collectively, the "Service").

By downloading, installing, creating an account, or using the DrawLink app, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Service.

2. Eligibility

You may use DrawLink only if:

• You are at least 13 years of age (or 16 in certain jurisdictions where a higher age applies, such as the European Economic Area).
• You are not prohibited from using the Service under applicable law.
• You have not previously been suspended or removed from DrawLink.

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Creating an Account

To access most features, you must create an account by providing accurate, complete, and up-to-date information (email address and display name). You agree to keep your account information current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at drawlink.support@gmail.com if you suspect unauthorized access to your account.

3.3 One Account per Person

You may only create one account per person. Creating multiple accounts to evade suspension or abuse the Service is prohibited.

3.4 Account Deletion

You may delete your account at any time from the app's Settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. License to Use the App

Subject to your compliance with these Terms, DrawLink grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the DrawLink app for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or sublicense the app or any part of it.
• Reverse engineer, decompile, or disassemble the app.
• Circumvent any security or access control measures.
• Use the app in any manner that violates applicable law.

5. User-Generated Content

5.1 Your Content, Your Responsibility

DrawLink allows you to post, upload, and share drawings, photos, captions, and messages ("Content"). You are solely responsible for all Content you post and for ensuring it complies with these Terms and applicable law.

5.2 Licence You Grant Us

By posting Content, you grant DrawLink a worldwide, non-exclusive, royalty-free, sublicensable licence to use, store, display, reproduce, and distribute your Content solely for the purpose of operating and improving the Service. You retain all ownership rights to your original artwork.

5.3 Content Standards

Your Content must not:

• Be unlawful, defamatory, obscene, harassing, threatening, or abusive.
• Infringe any third party's copyright, trademark, or other intellectual property rights.
• Contain nudity, sexually explicit material, or graphic violence.
• Promote hate speech, discrimination, or violence against individuals or groups.
• Include personal information of others without their consent.
• Constitute spam, unauthorized advertising, or phishing.

5.4 Reporting Content

If you encounter Content that violates these Terms, please report it in the app or contact us at drawlink.support@gmail.com. We will review reports and take appropriate action.

6. Prohibited Conduct

You agree not to:

• Use the Service to harass, bully, stalk, threaten, or harm any person.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload malware, viruses, or any code designed to disrupt or damage the Service.
• Use automated bots, scrapers, or scripts to access or use the Service.
• Attempt to gain unauthorized access to DrawLink's systems or other users' accounts.
• Engage in any activity that interferes with or disrupts the Service.
• Use the Service to transmit unsolicited commercial messages or spam.
• Create fake accounts or manipulate the leaderboard or any contest unfairly.
• Use the Service for any illegal purpose or in violation of applicable law.

7. Messaging Feature

DrawLink provides a private messaging feature that allows you to send text messages to your friends within the app. By using the messaging feature, you agree to:

• Only send messages to users who have consented to being your friend on DrawLink.
• Not use messages to harass, threaten, or spam other users.
• Not transmit illegal content, spam, phishing links, or harmful material.

DrawLink does not read or monitor private messages except where required by law or to investigate reported violations of these Terms. Please refer to our Privacy Policy for details on message storage and retention.

8. Weekly Drawing Contest

DrawLink may offer a weekly drawing feature where users submit drawings based on a theme and compete on a leaderboard based on likes received. By participating:

• You confirm that any drawing you submit is your own original work.
• You grant DrawLink a licence to display your submission in the contest feed and on the leaderboard.
• You understand that the leaderboard is based on community votes (likes) and that no monetary prizes are guaranteed unless explicitly stated.
• You agree not to manipulate contest results through the use of bots, fake accounts, or coordinated artificial voting.
• DrawLink reserves the right to disqualify submissions that violate these Terms or the spirit of the contest, at our sole discretion.

9. Intellectual Property

9.1 DrawLink's Intellectual Property

The DrawLink app, including its name, logo, design, code, and all content created by us, is owned by DrawLink and protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written permission.

9.2 Your Intellectual Property

You retain ownership of the drawings and artwork you create. The licence you grant us (see Section 5.2) does not transfer ownership of your artwork to us.

9.3 Copyright Infringement (DMCA)

If you believe your copyrighted work has been posted on DrawLink without your permission, please send a DMCA takedown notice to drawlink.support@gmail.com with:

• A description of the copyrighted work.
• A link or identification of the infringing content.
• Your contact information and a statement of good faith belief.

10. Third-Party Services

DrawLink uses third-party services (Supabase, Expo, Apple, Google) to operate the Service. These services have their own terms and privacy policies, which you are independently subject to. DrawLink is not responsible for the products, services, or content of any third-party services.

The Service is available on the Apple App Store and Google Play Store. Your use of the app is also subject to the relevant store's terms of service:

11. Termination

11.1 Termination by You

You may stop using the Service and delete your account at any time through the app settings.

11.2 Termination by DrawLink

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including Sections 5.2, 9, 12, 13, 14, and 15) will survive.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DrawLink does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DRAWLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL DRAWLINK'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DRAWLINK IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you. In such cases, our liability is limited to the fullest extent allowed by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless DrawLink and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of or inability to use the Service.
• Your Content or any content you transmit through the Service.
• Your violation of these Terms or any applicable law.
• Your violation of any third-party rights, including intellectual property rights.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which DrawLink is registered, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms that cannot be resolved informally shall be submitted to the competent courts of the applicable jurisdiction.

If you are an EU or UK consumer, nothing in these Terms prevents you from exercising your statutory rights under the consumer protection laws of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, the law, or the Service. When we make material changes, we will notify you via an in-app notification or by updating the "Last updated" date at the top of this page.

Your continued use of the Service after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
